Terms & Conditions
1. Acceptance of Terms
By creating an account, accessing, or using chapture (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully before proceeding. If you do not agree, do not create an account or use the Service.
Creating an account — by email, through a sign-in provider, or as a guest — constitutes your acceptance of these Terms and of our Privacy Policy. Your continued use of the Service following any update to these Terms constitutes acceptance of the changes.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that:
- You meet the minimum age requirement above;
- You have the legal capacity to enter into a binding agreement;
- Your use of the Service does not violate any applicable law or regulation.
3. User Accounts
To use the Service you register an account. You may sign up with an email address and password, or — where enabled — through a supported sign-in provider (such as Google), a phone number, or Sign in with Apple. You agree to provide accurate, current, and complete information and to keep it up to date.
You may not create an account on behalf of another person without their explicit consent, or use another person's account without authorization.
4. Guest Accounts
Where offered, a guest account lets you explore the Service without providing an email address. Guest accounts are stored on the device or browser you create them with and may be lost if you clear your data, switch devices, or sign out. A guest account cannot be recovered, and password reset, email confirmation, and cross-device sync are not available for it. If you want your writing to persist, convert to a full account.
5. Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to:
- Keep your password secure and not share it with any third party;
- Notify us at lifearchive.aven@gmail.com if you suspect unauthorized access to your account;
- Log out at the end of each session on shared devices.
If you enable per-diary encryption, you are responsible for safeguarding your passphrase and recovery code. Because encrypted diaries are sealed on your device, we cannot reset or recover an encryption passphrase. If you lose both the passphrase and recovery code, the affected diaries are permanently unreadable. See the Security page for details.
6. Your Content
The Service lets you create and store personal content — diaries, notes, decisions, photographs, voice recordings, tags, and other personal records ("User Content").
You retain full ownership of all User Content. chapture does not claim ownership over your writing, photographs, memories, or any other content you submit, and does not use it to train models, for advertising, or for any purpose other than operating the Service for you.
By storing content in the Service, you grant chapture a limited, non-exclusive, royalty-free license solely to host, process, and display that content back to you (and, where you explicitly choose to share it, to the people you share it with) as necessary to operate the Service. You are solely responsible for your content and represent that you have the rights necessary to store it and that it does not violate any third-party right or applicable law.
7. Public & Shared Content
By default your content is private to you. Some features let you make content visible to others — for example, marking a diary as a public diary, sharing an item into a chat, or publishing a journal summary. When you choose to share, you are responsible for what you disclose; anyone who can access shared content may read, and potentially copy or redistribute, it. Removing content from a shared surface does not guarantee that copies others already made are deleted.
8. Intellectual Property
All intellectual property rights in the Service itself — its software, design, interface, brand, and features — are owned by chapture or its licensors. These Terms grant you no rights in the Service beyond those needed to use it as intended. Your content remains yours; nothing here transfers ownership of your User Content to chapture.
9. Prohibited Activities
You agree not to use the Service to:
- Upload, store, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or that infringes another person's rights;
- Violate any applicable local, national, or international law or regulation;
- Attempt to gain unauthorized access to the Service, other users' accounts, or its infrastructure;
- Interfere with or disrupt the integrity or performance of the Service;
- Use automated tools, bots, or scrapers to access the Service without prior written consent;
- Reverse engineer, decompile, or disassemble any part of the Service except to the extent this restriction is prohibited by law;
- Resell, sublicense, or share account access with others.
We may investigate suspected violations and take appropriate action, including removing content or suspending or terminating accounts.
10. Service Availability & Changes
chapture is provided by an independent developer and evolves over time. We may modify, suspend, or discontinue the Service — or any feature — at any time, with or without notice, and will make reasonable efforts to give advance notice of significant changes where practicable. We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. New features may be released as beta and behave differently from the stable Service.
11. Third-Party Services
The Service relies on third-party providers for hosting, storage, email delivery, and optional integrations (for example, calendar sync with Google or Microsoft). When you connect an optional integration, your use of that provider is also governed by that provider's terms and privacy policy. chapture is not responsible for third-party services and does not control their independent practices. The Privacy Policy lists the providers we use.
12. Suspension & Termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms or if your use poses a risk to others or to the platform. You may terminate your account at any time from Settings, or by requesting deletion as described in the Privacy Policy. Upon termination your right to use the Service ceases immediately. Provisions that by their nature survive termination — including content ownership, limitation of liability, and disclaimers — continue to apply.
13. Limitation of Liability
To the fullest extent permitted by law, chapture, its operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the Service. In no event shall chapture's total aggregate liability to you exceed the greater of (a) the total amount you paid chapture in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).
Because you control your own content and, where applicable, your own encryption keys, you are responsible for keeping your own backups of anything you cannot afford to lose.
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, chapture disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be secure, error-free, or free of harmful components, or that stored data will be free from loss or corruption.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law provisions. Disputes arising under these Terms are subject to the exclusive jurisdiction of the courts located in that jurisdiction.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we revise the "Last Updated" date above and, where changes are material, provide notice through the Service or by email. Your continued use after an update takes effect constitutes acceptance of the revised Terms.
